By accessing and using SlashPlan's energy plan comparison platform ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service constitute a legally binding agreement between you and SlashPlan. If you do not agree to these terms, please do not use our Service.
2. Use of Site
SlashPlan provides an online platform for comparing energy plans and utility services. You may use our Service for lawful purposes only and in accordance with these Terms. You agree not to use the Service:
- In any way that violates any applicable federal, state, local, or international law or regulation
- To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
- To impersonate or attempt to impersonateSlashPlan, aSlashPlan employee, another user, or any other person or entity
- To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service
3. User Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.
You agree to immediately notify SlashPlan of any unauthorized uses of your account or any other breaches of security. SlashPlan cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.
4. Content and Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of SlashPlan and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
You retain ownership of any content you submit to the Service, but by submitting content, you grant SlashPlan a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content in connection with the Service.
5. Utility Bill Analysis Services
SlashPlan provides utility bill analysis services to help you understand your energy usage patterns and compare available energy plans. Our analysis is based on historical data and industry averages and is intended for informational purposes only.
While we strive for accuracy, SlashPlan does not guarantee that our analysis will be error-free or that it will perfectly predict future energy costs. You should consult with utility providers and conduct your own due diligence before making energy-related decisions.
6. Commercial Services
SlashPlan offers specialized services for commercial energy consumers, including custom rate analysis, demand management consultation, and energy procurement assistance. These services are provided by qualified energy professionals and are subject to separate terms and conditions.
Commercial services may require additional information from you, including but not limited to business credentials, historical usage data, and facility information. All information provided for commercial services will be handled in accordance with our Privacy Policy.
7. Smart Meter Texas Access Authorization
If you choose to authorize SlashPlan to access your Smart Meter Texas data, you expressly grant permission for SlashPlan to retrieve and analyze your historical and ongoing energy usage information for the purpose of providing personalized energy plan recommendations and usage analysis.
This authorization may be revoked at any time through your account settings or by contacting SlashPlan directly. Upon revocation, SlashPlan will cease accessing your Smart Meter Texas data within a reasonable timeframe, typically not exceeding 30 days.
8. Consent for Emails and Text Messages
By using our Service, you consent to receive electronic communications from SlashPlan, including emails and text messages related to your account, energy plan recommendations, service updates, and promotional offers.
You may opt out of promotional communications at any time by following the unsubscribe instructions in our emails or by contacting us directly. However, we may still send you transactional messages related to your account and our services.
9. Disclaimers
The information on this Service is provided on an 'as is' basis. To the fullest extent permitted by law, SlashPlan:
- Excludes all representations, warranties, and conditions relating to our Service and the use of this Service
- Excludes all liability for damages arising out of or in connection with your use of this Service
- Does not guarantee the accuracy or completeness of energy plan information provided by third-party providers
- Does not warrant that energy plans recommended will result in cost savings or meet your specific needs
10. Limitation of Liability
In no event shall SlashPlan, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your use or inability to use the Service
- Any unauthorized access to or use of our servers and/or any personal information stored therein
- Any interruption or cessation of transmission to or from the Service
- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service
- Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content
11. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Service.
12. Changes to Terms
SlashPlan reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
